Successful claim for inadequate skin care during in-patient stay leading to development of severe pressure damage and death.

The claim was pursued on behalf of the Estate of the deceased, who passed away in hospital as a consequence of osteomyelitis which had developed from severe pressure damage caused by inadequate skin care during a lengthy in-patient stay.  Although the deceased was very unwell in any event, the primary cause of death was osteomyelitis due to pressure damage.

The deceased did not have any dependents; the claim was limited to one for pain, suffering and loss of amenity over a limited period, and the advancement of death (so included funeral expenses, a limited claim for care and a bereavement award).

Although the Letter of Response conceded that the skin care had not been acceptable and that this had caused pressure damage, quantum was very much in dispute and attempts to negotiate settlement pre-issue were not successful. However, following issue of proceedings, and prior to service, the matter was resolved in the sum of £50,000.
